Nano User Scratches Apple With Lawsuit

The cool, trendy, hip iPod Nano media player gained the usual love and devotion from the Apple faithful, until many people began to see scratches on the device.
The original bad publicity started by a disgruntled iPod Nano purchaser over a cracked Nano screen. Told initially by Apple that it wasn't their problem, Matthew Peterson launched a web site and collected complaints from other users.
Apple later acknowledged quality issues with a few Nanos and
offered to replace those with cracked screens. The greater issue,
of Nanos scratching easily, has not went away. A user named
Jason Tomczak has filed a lawsuit in San Jose District Court
over the problem, the BBC reported.
After his first Nano became scratched "excessively during normal usage," he paid a $25 fee to get a replacement Nano. That one also quickly became scratched. His suit seeks class action status on behalf of other Nano purchasers affected by the problem.
The complaint said Apple used a thinner coating on the Nanos than it has on other iPod models. Reuters noted lawyers for Tomczak claim Apple "failed to remedy the problem in any meaningful way" and deleted postings on its Web site about the scratching problem.
